At Helena Araújo Lopes Xavier e Associados – Sociedade de Advogados, SP, RL (“HALX Advogados”), privacy and security are priorities, and we are committed to transparency during the personal data treatment of our Clients and Users. 

Therefore, the Privacy Policy in question establishes how the collection, use, and transfer of information from clients and/or users of our website is made. 

By using our services, you understand that we will collect and use your personal information in the ways described in this Policy, according to the Regulation (EU) No 2016/679 issued by the European Parliament and the Council on April 27, 2016 (“General Data Protection Regulation” or “GDPR”), to the National Data Protection Law (Law No 59/2019, August 8), and other applicable rules of the Portuguese legal system.

Thus, HALX Advogados, in the Data Controller role, is bonded by the Provisions of this Privacy Policy.

1. Which data do we collect about you, and for what purpose?

Our website collects and uses some of your data, in order to enable the services provision and improve the user experience, whose data consist of name, telephone, email, among others. 

Besides that, within the scope of the services provision, the firm will process data related to the cases in which assistance has been requested, such as (non-limited list): identification data, i.e., name, contacts, nationality, passport, gender, Portuguese Taxpayer Number (NIF), address, among other data.

2. How do we collect your data?

The data can be collected by filling out the form contained in the website Contact tab, sending an email, or using the consultation and notary services appointment tool.

2.1. Consent

It is from your consent that we process your personal data. Consent is the free, informed, and unequivocal expression by which you authorize HALX Advogados to process your data.

Thereafter, in line with the General Data Protection Regulation and the National Data Protection Law, your data will only be collected, processed, and stored with prior and express consent. 

Your consent will be obtained specifically for each purpose described above, demonstrating the firm's commitment to transparency and good faith towards its Clients and/or Users, following the relevant legislative regulations.

It is important to highlight that the consent revocation for data processing may imply the impossibility of the adequate performance of some website functionality that depends on the operation. Such consequences will be informed in advance.

5. How and for how long will your data be stored?

Your personal data collected by HALX Law Firm will be used and stored during the necessary time for the service provision or for the purposes listed in this Privacy Policy to be achieved, considering the data subjects’ and controllers’ rights.

In general, your data will be kept as long as the contractual relationship between you and HALX Law Firm lasts. After the storage period of personal data ends, they will be deleted from our databases or anonymized, except in the cases legally provided for by law.

It means that personal information about you, which are essential for the fulfillment of legal, judicial, and administrative determinations and/or for the exercise of the defense right in judicial and administrative proceedings will be kept, despite the exclusion of other data.

The storage of data collected by HALX Law Firm reflects our commitment to the security and privacy of your data. We employ technical protection measures and solutions capable of guaranteeing your data’s confidentiality, integrity, and inviolability.

Besides that, we also have security measures appropriate to the risks and access control to stored information.

6. How do we do to keep your data safe?

To keep your data safe, we use physical, electronic, and managerial tools to protect your privacy.

We apply these tools by considering the nature of the personal data collected, the context and the treatment purpose, and the risks that any violations would generate for the rights and freedoms of the data subject collected and processed. 

Among the measures we have adopted, we highlight the following: 

  • Only authorized people have access to your personal data;
  • The access to your personal data is made only after a commitment to confidentiality, and  
  • Your personal data is stored in a safe and reliable.  

HALX Law Firm is committed to adopting the best postures to avoid security incidents. However, it is necessary to point out that the virtual page is entirely safe and risk-free. It is possible that, despite all our security protocols, problems exclusively caused by third parties occur, such as cyber-attacks by hackers, or also as a result of the negligence or imprudence of the User and/or Client.

In case of security incidents that may generate relevant risk or damage for you or any of our Users and Clients, we undertake to report such breach to the National Data Protection Commission (CNPD), within 72 (seventy-two) hours from the knowledge of the incident and to the personal data subjects whenever such breach is likely to entail a high risk to their rights.

7. With whom can your data be shared?

In order to preserve your privacy, HALX Law Firm will not share your personal data with any unauthorized third party. 

Your data, however, may be shared with our business partners, whenever necessary for the provision of the contracted services, and our contracts are guided by the data protection standards of the European Union and the Portuguese legal system. 

In addition, there are also other hypotheses in which your data may be shared, which are:

  1. Legal determination, request, requisition, or court order, with competent judicial, administrative, or governmental authorities; 
  2. In case of corporate transactions, such as mergers, acquisitions, and incorporation, automatically;
  3. Protection of the rights of HALX Law Firm in any type of conflict, including those of legal nature.
7.1. International data transfer

Some of the third parties with whom we share your data may be located or settled in foreign countries Under these conditions, in any case, your personal data will be subject to the General Data Protection Regulation and the National Data Protection Law, and to other Portuguese Data Protection Legislation. 

In this sense, HALX Law Firm is committed to always adopting efficient cybersecurity and data protection standards in the best efforts to guarantee and comply with legislative requirements.

8. Cookies or browsing data

HALX Law firm uses Cookies, which are text files sent by the platform to your computer and stored there. These contain information related to website navigation and, in sum, Cookies are used to improve the user experience. It is important to highlight that there is no collection of your personal data through Cookies.

By accessing our website and consenting to Cookies, you declare that you know and accept the use of a navigation data collection system through the use of Cookies on your device.

9. Amendment of this Privacy Policy

This Privacy Policy comes into force on June 25, 2022  and was last updated on June 25, 2022.

We reserve the right to modify this Privacy Policy at any time, mainly depending on the adequacy of any changes made to our website or in the legislative scope. Therefore, we recommend that you review it frequently.

Possible alterations will come into force by the time they are published on our website, and we will always notify you of the changes. 

By using our services and providing your personal data after such modifications, you consent to them.

10. Liability

HALX Advogados provides for the agents’ liability who work in the data processing.  We undertake to keep the Privacy Policy updated, observing its provisions and ensuring compliance.

Besides that, we are also committed to seeking technical and organizational conditions that are safely able to protect the entire data processing process.

If the National Data Protection Commission (CNPD) requires the addition of measures about data processing made by HALX Law Firm, we undertake to follow them.

10.1. Disclaimer

As mentioned in topic 6, although we adopt high-security standards in order to avoid incidents, there is no virtual page that is entirely risk-free. In this sense, HALX Advogados is not responsible for:

  1. Any consequences arising from users’ negligence, recklessness, or malpractice about their individual data. We guarantee and are only responsible for the security of the data processing processes and fulfilling the purposes described in this document. We emphasize that the responsibility in relation to the confidentiality of the access data lies with the User; 
  2. Malicious actions by third parties, such as hacker attacks, unless HALX Advogados has demonstrated willful conduct or that it did not act with intent. We emphasize that in the event of security incidents that may generate relevant risk or damage to you or any of our Customers and Users, we will communicate to those affected and the National Data Protection Commission (CNPD) about what happened and take the necessary measures;
  3. Inaccuracy of the information entered by the Client and/or User in the records necessary for the use of HALX Advogados services; any consequences arising from false information or entered in bad faith are entirely the liability of the User and the Client.
